Thailand Leads Cross-Regional Joint Statement at HRC63 to Strengthen Global Action against Trafficking in Persons in the Context of Online Scams Supported by Over 40 Countries

On 11 September 2026, at the 63rd session of the Human Rights Council (HRC63) in Geneva, Thailand took the lead in initiating a Joint Statement on Trafficking in Persons in the Context of Online Scams, delivered by H.E. Ms. Usana Berananda, Ambassador and Permanent Representative of Thailand to the United Nations in Geneva during the Interactive Dialogue with the Special Rapporteur on contemporary forms of slavery and trafficking in persons. The Joint Statement received support from more than 40 countries from all regions of the world, reflecting growing international concern over the rapidly expanding scale of online scam operations and their serious human rights impacts.
The Joint Statement drew attention to the industrial scale of online scams and their links to contemporary forms of slavery, trafficking in persons and transnational organised crime. It highlighted that at least 300,000 people from 80 countries work in scam compounds, where many are subjected to confinement, trafficking for forced criminality, physical and sexual violence, torture and other serious human rights violations.
Recognising that scam networks operate across borders and increasingly exploit digital technologies, corruption, gaps in the rule of law and vulnerabilities across jurisdictions, the Joint Statement called for a coordinated global response firmly rooted in human rights. It underscored the importance of applying a victim-centred approach, as well as the principle of non-punishment for unlawful activities that victims were compelled to commit as a direct consequence of being trafficked.
The Joint Statement also called for stronger cooperation among States, international organisations, civil society, financial institutions and technology companies to promote prevention, prosecute criminal networks, combat corruption, disrupt illicit financial flows, strengthen victim protection and ensure accountability.
This initiative, together with Thailand’s hosting of the side event entitled “Beyond Jurisdictional Gap: State Responsibility, Technical Cooperation and International Partnership Against Trafficking in Persons in the Context of Online Scams,” during the same meeting,[1] reflects Thailand’s commitment to strengthening international cooperation to address the rapidly expanding global threat of online scams and their harmful impacts worldwide. Thailand will continue to promote responses grounded in human rights, while advancing accountability for perpetrators and criminal networks.

เมื่อวันที่ 11 กันยายน 2569 ในระหว่างการประชุมคณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ สมัยที่ 63 (HRC63) ณ นครเจนีวา ในช่วงการหารือผู้เสนอรายงานพิเศษแห่งสหประชาชาติว่าด้วยรูปแบบร่วมสมัยของการเป็นทาสและการค้ามนุษย์ นางสาวอุศณา พีรานนท์ เอกอัครราชทูตผู้แทนถาวรไทยประจำสหประชาชาติ ณ นครเจนีวา ได้กล่าวถ้อยแถลงร่วมหัวข้อการค้ามนุษย์ในบริบทของการหลอกลวงออนไลน์ (Joint Statement on Trafficking in Persons in the Context of Online Scams) โดยเป็นข้อริเริ่มของไทยซึ่งได้รับการสนับสนุนจากกว่า 40 ประเทศจากภูมิภาคต่าง ๆ ทั่วโลก สะท้อนถึงความห่วงกังวลที่เพิ่มขึ้นของประชาคมระหว่างประเทศต่อการขยายตัวอย่างรวดเร็วของขบวนการหลอกลวงออนไลน์และผลกระทบต่อสิทธิมนุษยชน
ถ้อยแถลงร่วมได้เน้นย้ำถึงการขยายตัวในระดับอุตสาหกรรมของการหลอกลวงออนไลน์ รวมถึงความเชื่อมโยงกับรูปแบบร่วมสมัยของการเป็นทาส การค้ามนุษย์ และอาชญากรรมข้ามชาติ โดยข้อมูลระบุว่า มีบุคคลอย่างน้อย 300,000 คนจาก 80 ประเทศ ทำงานอยู่ในศูนย์หลอกลวงออนไลน์ ซึ่งหลายคนต้องเผชิญกับการกักขัง การค้ามนุษย์เพื่อบังคับให้กระทำความผิด และการละเมิดสิทธิมนุษยชนอย่างร้ายแรงในรูปแบบอื่น ๆ
ถ้อยแถลงร่วมเรียกร้องให้มีความร่วมมือในระดับโลกบนพื้นฐานของสิทธิมนุษยชน พร้อมทั้งเน้นย้ำความสำคัญของแนวทางที่ยึดผู้เสียหายเป็นศูนย์กลาง รวมถึงการใช้หลักการไม่ลงโทษผู้เสียหายสำหรับการกระทำที่ผิดกฎหมายซึ่งผู้เสียหายถูกบังคับให้กระทำอันเป็นผลโดยตรงจากการตกเป็นเหยื่อการค้ามนุษย์ โดยตระหนักว่าเครือข่ายอาชญากรรมดังกล่าวดำเนินการข้ามพรมแดน และใช้ประโยชน์จากเทคโนโลยีดิจิทัล การทุจริต ช่องว่างด้านหลักนิติธรรม และข้อจำกัดในเขตอำนาจของประเทศต่าง ๆ
นอกจากนี้ ถ้อยแถลงร่วมยังเรียกร้องให้รัฐ องค์การระหว่างประเทศ ภาคประชาสังคม สถาบันการเงิน และบริษัทเทคโนโลยี เสริมสร้างความร่วมมือในการป้องกันการค้ามนุษย์และการหลอกลวงออนไลน์ การดำเนินคดีกับเครือข่ายอาชญากรรม การต่อต้านการทุจริต การสกัดกั้นการไหลเวียนของเงินที่ผิดกฎหมาย การเสริมสร้างการคุ้มครองผู้เสียหาย และการส่งเสริมความรับผิดชอบต่อการกระทำผิด
ข้อริเริ่มดังกล่าว ร่วมกับการเป็นเจ้าภาพจัดกิจกรรมคู่ขนานหัวข้อ “Beyond Jurisdictional Gap: State Responsibility, Technical Cooperation and International Partnership Against Trafficking in Persons in the Context of Online Scams” ในห้วงการประชุมเดียวกัน [1] สะท้อนถึงความมุ่งมั่นของไทยในการส่งเสริมความร่วมมือระหว่างประเทศ เพื่อรับมือกับปัญหาการหลอกลวงออนไลน์ที่กำลังขยายตัวอย่างรวดเร็วและสร้างความเสียหายไปทั่วโลก โดยคำนึงถึงสิทธิมนุษยชน การคุ้มครองเหยื่อการค้ามนุษย์ และช่วยเหลือผู้เสียหาย ตลอดจนส่งเสริมความรับผิดชอบของผู้กระทำผิดและเครือข่ายอาชญากรรมต่อไป
