On 5 October 2026, during the 63rd Session of the United Nations Human Rights Council (HRC) in Geneva, Ambassador Pratana Disyatat, Deputy Permanent Representative and Chargé d’Affaires a.i., Permanent Mission of Thailand to the UN in Geneva, exercised Thailand’s Right of Reply in response to a statement made by Cambodia during the Interactive Dialogue with the Special Rapporteur on the situation of human rights in Cambodia.

Thailand reiterated that it did not initiate the conflict and stated that Cambodia continued to use international fora to advance allegations against Thailand while deflecting attention from its own actions and responsibilities. Thailand stressed that such repeated provocations run counter to the terms and spirit of the ceasefire, under which both sides agreed to refrain from actions that could escalate tensions.

In reply to Cambodia’s assertion that all refugees from the 1970s have returned, Thailand clarified a fact also known to Cambodia that some Cambodians remained in areas under Thai territory after the closure of the temporary shelters. These settlements continued to expand over time. Despite Thailand’s repeated protests, Cambodia took no corrective action against this encroachment into Thai territory. Furthermore, during the conflict, Cambodian authorities had mobilized civilians, including women and children, in these areas to engage in provocative confrontation that heightened tensions.

Rejecting Cambodia’s allegation that the issue of online scams had been used as a pretext for territorial encroachment, Thailand clarified that its actions were taken in response to armed attacks launched against Thai territory from areas where scam compounds were located, in the exercise of its right to self-defence. Evidence of Industrial-scale scam compounds was subsequently uncovered in these areas and has since been independently documented and brought to international attention by various media.

Thailand further firmly rejected allegations of occupation and stated that its provisional security measures are consistent with the ceasefire agreement, under which both sides agreed to maintain existing troop deployments at the time of the ceasefire to prevent further confrontation, without prejudice to the border demarcation process under established bilateral mechanisms.

Reaffirming its full commitment to the ceasefire agreement, Thailand stressed that lasting peace requires both sides to implement their commitments in good faith and in their entirety and called on Cambodia to sincerely implement the relevant de-escalation measures to create an atmosphere conducive to rebuilding trust and pursuing further discussions through existing bilateral mechanisms.

ไทยใช้สิทธิตอบโต้ในการประชุมคณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ สมัยที่ 63 ชี้แจงข้อเท็จจริงกรณีกัมพูชารุกล้ำดินแดน ปฏิเสธข้อกล่าวหาของกัมพูชาเรื่องการยึดครอง และย้ำหลักฐานเกี่ยวกับศูนย์หลอกลวงออนไลน์

เมื่อวันที่ 5 ตุลาคม 2569 ในระหว่างการประชุมคณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ (Human Rights Council: HRC) สมัยที่ 63 ณ นครเจนีวา เอกอัครราชทูต รองผู้แทนถาวรฯ นางสาวปรารถนา ดิษยทัต อุปทูต คณะผู้แทนถาวรไทยประจำสหประชาชาติ ณ นครเจนีวา ได้ใช้สิทธิตอบโต้ (Right of Reply) ต่อถ้อยแถลงของกัมพูชาในช่วงการหารือเชิงโต้ตอบกับผู้เสนอรายงานพิเศษแห่งสหประชาชาติว่าด้วยสถานการณ์สิทธิมนุษยชนในกัมพูชา

ไทยย้ำว่า ไม่ได้เป็นฝ่ายเริ่มต้นความขัดแย้ง และระบุว่า กัมพูชายังคงใช้เวทีระหว่างประเทศในการเผยแพร่ข้อมูลที่ไม่ถูกต้องและกล่าวหาไทย ขณะเดียวกันเบี่ยงเบนความสนใจจากการกระทำและความรับผิดชอบของตนเอง ไทยเน้นย้ำว่า การยั่วยุซ้ำ ๆ ดังกล่าวขัดต่อเงื่อนไขและเจตนารมณ์ของข้อตกลงหยุดยิง ซึ่งกำหนดให้ทั้งสองฝ่ายงดเว้นการกระทำที่อาจทำให้สถานการณ์ตึงเครียดมากขึ้น

ต่อข้อกล่าวอ้างว่าผู้ลี้ภัยจากช่วงทศวรรษ 1970 ได้เดินทางกลับกัมพูชาหมดแล้วนั้น ไทยชี้แจงว่า ชาวกัมพูชาบางส่วนยังคงพำนักอยู่ในพื้นที่ภายใต้ดินแดนไทยภายหลังการปิดพื้นที่พักพิงชั่วคราวซึ่งฝ่ายกัมพูชาทราบข้อเท็จจริงนี้ดี โดยไทยระบุว่า ชุมชนดังกล่าวได้ขยายตัวและเพิ่มจำนวนประชากรมาอย่างต่อเนื่อง แม้ไทยจะได้ประท้วงหลายครั้ง และกัมพูชาเคยดำเนินการแก้ไขการรุกล้ำเข้ามาในดินแดนไทยดังกล่าว อีกทั้งในช่วงความขัดแย้ง ฝ่ายกัมพูชาได้ระดมพลเรือน รวมถึงสตรีและเด็ก ในพื้นที่ดังกล่าวในลักษณะที่เป็นการเผชิญหน้าและเพิ่มความตึงเครียด

ไทยยังปฏิเสธข้อกล่าวหาของกัมพูชาที่ว่า ไทยใช้ประเด็นการหลอกลวงออนไลน์เป็นข้ออ้างในการรุกล้ำดินแดน โดยการดำเนินการของไทยเป็นการใช้สิทธิในการป้องกันตนเองจากการตอบโต้การโจมตีด้วยอาวุธต่อไทย จากพื้นที่ซึ่งเป็นที่ตั้งของศูนย์ปฏิบัติการหลอกลวงออนไลน์ ทั้งนี้ ภายหลังได้พบหลักฐานของศูนย์ปฏิบัติการหลอกลวงออนไลน์ขนาดใหญ่ ซึ่งต่อมาได้รับการบันทึกและรายงานสู่ประชาคมระหว่างประเทศ โดยสื่อระหว่างประเทศอิสระหลายแห่ง

ไทยยังปฏิเสธต่อข้อกล่าวหาเรื่องการยึดครอง โดยย้ำว่า ภายใต้ข้อตกลงหยุดยิง ทั้งสองฝ่ายตกลงที่จะคงกำลังทหารไว้ตามที่ประจำการอยู่ ณ เวลาที่มีการหยุดยิง และไม่ดำเนินกิจกรรมนอกพื้นที่ของแต่ละฝ่าย โดยไม่กระทบต่อกระบวนการปักปันเขตแดนภายใต้กลไกทวิภาคีที่มีอยู่ ไทยระบุว่า มาตรการด้านความมั่นคงชั่วคราวที่ดำเนินการโดยฝ่ายไทยสอดคล้องกับข้อตกลงหยุดยิงและมีวัตถุประสงค์เพื่อป้องกันมิให้เกิดการเผชิญหน้า

ไทยยืนยันความยึดมั่นอย่างเต็มที่ต่อข้อตกลงหยุดยิง พร้อมเน้นย้ำว่า สันติภาพที่ยั่งยืนจำเป็นต้องอาศัยการที่ทั้งสองฝ่ายปฏิบัติตามพันธกรณีอย่างจริงใจและครบถ้วน โดยเรียกร้องให้กัมพูชาดำเนินมาตรการต่าง ๆ อย่างจริงจัง เพื่อสร้างบรรยากาศที่เอื้อต่อการฟื้นฟูความไว้วางใจและการหารือต่อไปผ่านกลไกทวิภาคี
